Introduction
Welcome to Medicare Transit. These Terms of Use (“Terms”) govern your access to and use of our website, mobile site, mobile application, ride request tools, and related services (collectively, the “Service”).
By using our Service, you agree to these Terms. If you do not agree, please do not use the Service.
Non-Emergency Transportation Only
Medicare Transit provides non-emergency medical transportation services and related scheduling or communication support.
Our Service is not a substitute for emergency medical care or emergency transportation. If you are experiencing a medical emergency, call 911 immediately. Do not use our website, form submissions, email, text messages, or phone support as a substitute for emergency assistance.
Eligibility & Authorized Use
You may use our Service only for lawful purposes and only if you are authorized to request or manage transportation for yourself or another rider.
If you submit information on behalf of a patient, family member, facility resident, or other rider, you represent that you are authorized to provide that information and request service on their behalf.
Ride Requests & Confirmation
Submitting a ride request does not guarantee availability or confirmation.
A trip is considered scheduled only after Medicare Transit confirms it through an authorized representative or official communication channel. Service availability may depend on scheduling capacity, vehicle availability, staffing, service area, rider needs, authorization status, weather, traffic, and other operational factors.
Accurate Rider Information
You agree to provide complete and accurate information, including pickup and drop-off details, appointment timing, contact information, mobility level, transportation type, escort needs, and any other information reasonably necessary to safely coordinate service.
Failure to provide accurate information may result in delays, inability to complete service, or cancellation of the ride request.
Mobility, Safety & Special Requirements
You are responsible for informing us of any mobility-related or ride-related needs that may affect service, including but not limited to wheelchair use, stretcher needs, walker use, assistance needs, oxygen equipment, bariatric requirements, or other relevant transport conditions.
Medicare Transit may decline or reschedule service if the requested transportation type does not match the rider’s actual condition or safety needs.
Companions, Escorts & Additional Riders
Companions, escorts, caregivers, or family members may be permitted only when disclosed in advance and approved based on available vehicle capacity and service type.
Unannounced additional passengers may result in delay, denial, or rescheduling of service.
Pickup Readiness & Wait Time
Riders and authorized escorts are expected to be ready at the scheduled pickup time.
Drivers may wait for a reasonable period after arrival, but extended wait times may affect scheduling, later pickups, or additional fees where permitted. If a rider is not ready within the applicable wait period, the trip may be treated as a cancellation or no-show.
Cancellations, Rescheduling & No-Shows
We ask that cancellations or schedule changes be made as early as possible.
Late cancellations, repeated last-minute schedule changes, or rider no-shows may result in service limitations, added charges for private-pay trips, or loss of future scheduling priority, subject to applicable law and payer rules. Separate cancellation policy terms may apply where posted.
Payment, Coverage & Authorizations
Some trips may be covered through private pay, healthcare facilities, insurers, managed care plans, or other third-party payers. Coverage decisions, prior authorization requirements, and reimbursement decisions are controlled by the applicable payer or contracting party, not by Medicare Transit unless expressly stated otherwise.
You remain responsible for charges that are not covered, authorized, or paid by a third party, unless prohibited by law or controlled by a separate written agreement.
Delays, Service Interruptions & Operational Changes
Pickup windows, arrival times, and scheduled service may be affected by traffic, weather, road conditions, facility discharge timing, rider readiness, mechanical issues, staffing constraints, public safety issues, or other conditions outside our reasonable control.
We reserve the right to delay, reschedule, modify, or decline service where reasonably necessary for safety, legal compliance, or operational integrity.
Conduct & Refusal of Service
Riders, family members, escorts, and anyone using our Service must behave respectfully and safely.
We may refuse, stop, or limit service where there is threatening behavior, unsafe conditions, harassment, abuse, unlawful activity, undisclosed transport risk, or any circumstance that creates a safety concern for the rider, driver, staff, or vehicle.
Communications
By submitting your contact information, you agree that Medicare Transit may contact you by phone, email, or SMS regarding ride scheduling, confirmations, updates, service-related notices, and support. Standard messaging and data rates may apply.
Website Content & Intellectual Property
All website content, including text, branding, graphics, logos, layouts, and design elements, is owned by Medicare Transit or its licensors and may not be copied, republished, distributed, or exploited without prior written permission, except as allowed by law.
Third-Party Links & Services
Our website or digital services may contain links to third-party websites, maps, tools, or service providers. We are not responsible for third-party content, terms, availability, or privacy practices.
Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis to the fullest extent permitted by law.
We do not guarantee uninterrupted website availability, error-free operation, or guaranteed ride fulfillment in every circumstance.
Limitation of Liability
To the fullest extent permitted by law, Medicare Transit and its affiliates, owners, employees, contractors, and agents are not liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the Service.
Our total liability for any claim relating to the Service will not exceed the amount, if any, paid directly to Medicare Transit for the specific service giving rise to the claim, unless otherwise required by law.
Privacy
Your use of our Service is also subject to our Privacy Policy, which explains how we collect, use, and protect information.
Changes to These Terms
We may update these Terms from time to time. Updated versions will be posted on this page with a revised effective date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Any dispute arising from or relating to these Terms or the Service shall be handled in the appropriate courts of California, unless applicable law requires otherwise.
